Terms of Service
These terms set the ground rules for using The Live Market as a public marketplace user, account holder, business user, or organisation administrator.
1. Agreement to these terms
These Terms of Service govern access to and use of The Live Market websites, marketplace, accounts, business tools, integrations, support channels, and related platform services. By using TLM, creating an account, accepting these terms, or continuing to use the platform after an update, you agree to these terms.
2. Additional terms
Some modules, plans, orders, bookings, payments, subscriptions, business workspaces, promotions, integrations, or partner services may have additional terms. If additional terms apply, they form part of the agreement for that specific feature or transaction. If there is a conflict, the more specific terms apply to the relevant feature or transaction.
3. Accounts and security
- You must provide accurate account information and keep it up to date.
- You are responsible for activity under your account, organisation, API keys, integrations, and invited users.
- You must keep credentials confidential and notify us promptly if you suspect unauthorised access.
- We may suspend or restrict access where needed to protect users, organisations, the platform, or legal compliance.
4. Marketplace role
TLM provides a platform for discovery, communication, booking, ordering, reservations, enquiries, promotions, events, listings, and business workflows. Unless stated otherwise, businesses using TLM are responsible for their own listings, prices, availability, services, products, fulfilment, customer commitments, policies, taxes, licences, and legal compliance.
5. Business users and organisations
- Organisation administrators are responsible for configuring their workspace, managing users and permissions, and ensuring only authorised people access business data.
- Businesses must have the rights and permissions needed to publish listings, upload content, contact customers, process orders or bookings, and use customer data.
- Businesses must keep public information accurate, including prices, availability, service descriptions, location details, and cancellation or refund terms.
- Businesses must not use TLM to mislead customers, evade legal obligations, or process data they are not entitled to process.
6. Acceptable use
You may not misuse the platform or interfere with its operation.
- Do not upload unlawful, harmful, misleading, infringing, abusive, discriminatory, or malicious content.
- Do not attempt unauthorised access, scraping, probing, reverse engineering, abuse of APIs, or circumvention of security or rate limits.
- Do not use TLM for spam, fraud, deceptive listings, counterfeit goods, illegal services, or activity that violates applicable law.
- Do not disrupt another user, organisation, customer, or platform workflow.
7. Content and data
You keep ownership of content you submit, subject to the rights you grant us to operate and improve the platform. You grant TLM a worldwide, non-exclusive, royalty-free licence to host, process, display, transmit, copy, secure, back up, and adapt submitted content as needed to provide the platform, support users, maintain integrations, and comply with law. You represent that you have the rights needed to submit that content.
8. Payments, bookings, orders, and cancellations
Where payments, bookings, reservations, orders, tickets, deposits, refunds, cancellations, or no-show policies are supported by the platform, the applicable commercial terms may be set by the relevant business, payment provider, event organiser, or TLM plan. Users should review transaction-specific terms before confirming. TLM may keep records needed for audit, support, dispute handling, and legal compliance.
9. Third-party services
The platform may integrate with third-party services such as payment processors, authentication providers, maps, messaging, analytics, communication systems, or business tools. Those services may be subject to their own terms and privacy notices. TLM is not responsible for third-party services outside our reasonable control.
10. Availability and changes
We aim to provide a reliable platform, but we do not guarantee uninterrupted or error-free service. We may update, suspend, discontinue, or change features, modules, designs, plans, integrations, or access where needed for security, maintenance, business reasons, compliance, or product improvement.
11. Intellectual property
The Live Market platform, software, interfaces, designs, names, logos, infrastructure, documentation, and related materials are owned by TLM or its licensors. These terms do not transfer any platform intellectual property to users or organisations. Feedback may be used without restriction or compensation.
12. Disclaimers
The platform is provided on an as-is and as-available basis to the fullest extent permitted by law. TLM does not guarantee that listings, business information, availability, prices, customer content, third-party services, or AI-assisted outputs are complete, current, accurate, or suitable for a particular purpose. Users and organisations remain responsible for reviewing information before acting on it.
13. Liability
To the fullest extent permitted by law, TLM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity. Nothing in these terms excludes liability that cannot be excluded under applicable law.
14. Termination
You may stop using the platform at any time. We may suspend or terminate access where there is breach, risk, non-payment, legal requirement, security concern, inactivity, or misuse. Termination does not affect rights or obligations that should reasonably survive, including payment obligations, records, dispute provisions, confidentiality, intellectual property, and liability limits.
15. Governing law
Unless a separate written agreement states otherwise, these terms are governed by the laws of Malta. The courts of Malta will have jurisdiction, subject to mandatory consumer rights or other laws that cannot be excluded.
